POPLA vs Traffic Penalty Tribunal

By GetRighted Legal Research TeamLast updated July 2026

Summary

POPLA is for private parking charges from BPA-member operators. The Traffic Penalty Tribunal (TPT) is for council-issued Penalty Charge Notices. You cannot choose between them — the type of ticket determines the route. POPLA focuses on whether the operator met contractual and POFA 2012 requirements. TPT focuses on whether the council's enforcement complied with the Traffic Management Act 2004. Both are free and independent. Around 40–50% of POPLA appeals succeed; over 60% of TPT decisions favour the motorist (sources: POPLA published statistics; TPT annual report). Check who issued your ticket before appealing to the wrong body.

POPLA vs Traffic Penalty Tribunal at a glance

POPLA: private parking charges (BPA operators). Free. Paper-based. Focuses on POFA 2012, signage, contractual terms. Binding on operator.

TPT: council PCNs. Free. Paper or telephone hearing. Focuses on TMA 2004, TMO validity, signage compliance. Binding on council.

When POPLA applies

POPLA handles Stage 2 appeals for private parking charges issued by BPA-member operators (ParkingEye, APCOA, NCP, etc.). You can only go to POPLA after the operator rejects your Stage 1 appeal. The operator provides a POPLA verification code with their rejection. POPLA adjudicators assess whether the charge was properly issued under the BPA Code and POFA 2012.

When the Traffic Penalty Tribunal applies

TPT handles appeals against council parking and traffic PCNs after the council rejects your formal representations. You submit online or by post. An adjudicator reviews the case on paper or via telephone hearing. TPT decisions are legally binding on the council — if you win, the PCN is cancelled.

IAS is the third option

If your ticket is from an IPC-member operator (not BPA), your Stage 2 appeal goes to IAS (Independent Appeals Service), not POPLA. Check the trade body membership on the ticket or the operator's website.

Success rates

POPLA: approximately 40–50% of appeals are allowed. TPT: over 60% of adjudicated cases decided in the motorist's favour. Sources: POPLA published statistics; Traffic Penalty Tribunal annual report.

Frequently Asked Questions

Can I appeal to POPLA for a council PCN?
No. POPLA only handles private parking charges from BPA-member operators. Council PCNs are appealed to the Traffic Penalty Tribunal after formal representations are rejected.
Is there a fee for POPLA or the Traffic Penalty Tribunal?
Both are free for the motorist. There is no cost risk regardless of the outcome.
What if my operator is IPC, not BPA?
IPC-member operators use IAS (Independent Appeals Service) instead of POPLA. The process is similar — check the rejection letter for details.
Are the decisions binding?
Yes. POPLA decisions are binding on the operator (though the motorist can still go to court if they disagree). TPT decisions are binding on the council.
