Council PCN Appeal Deadline — 28 Days From Notice to Owner

By GetRighted Legal Research TeamLast updated July 2026

Summary

The deadline to submit an informal representation against a council PCN is 28 days from the Notice to Owner. You also have 14 days for a 50% discount on the charge — but paying waives your appeal right. If your informal representation is rejected, you have 28 days from the Notice of Rejection to appeal to Traffic Penalty Tribunal (outside London) or London Tribunals. Missing any deadline triggers automatic escalation and a 50% penalty surcharge via Charge Certificate.

Council PCN Escalation Dates

The council PCN deadline timeline under TMA 2004:

  1. 1PCN issued: Day 0 — observation or camera evidence
  2. 2Days 1–14: 50% discount period — pay at half price OR start appeal process
  3. 3Days 1–28 from Notice to Owner: Submit informal representation — hard deadline
  4. 4Within 56 days: Council issues Notice of Acceptance or Notice of Rejection
  5. 528 days from Notice of Rejection: Appeal to Traffic Penalty Tribunal / London Tribunals
  6. 6If no tribunal appeal: Charge Certificate issued — penalty increases by 50%
  7. 7Charge Certificate to enforcement: Debt registered, enforcement via bailiffs

What Happens If You Miss the 28-Day Deadline

Missing the 28-day informal representation deadline means the council can issue a Charge Certificate, increasing the total by 50%. After that, the debt is registered at the Traffic Enforcement Centre and enforcement agents (bailiffs) can be instructed. There is no discretionary extension — courts have limited jurisdiction to intervene after the statutory process has run. Act within 28 days.

What to Do Now

If you just received a council PCN:

  • Note the NtO date — count 28 days forward to your hard appeal deadline
  • Request the civil enforcement officer's observation photographs immediately
  • Photograph the signs and road markings at the location
  • Request the Traffic Management Order for the specific restriction
  • Draft and submit your informal representation — do not wait until day 27
  • Keep copies of everything you submit to the council

Legal Basis

Traffic Management Act 2004, s.78 and Schedule 9: the council must serve a Notice to Owner; the recipient has 28 days to make representations. Regulation 4 of the Civil Enforcement of Parking Contraventions (England) General Regulations 2007: deadline for informal representations is 28 days from the NtO date. TMA 2004, Schedule 9, Para 8: failure to represent within 28 days results in the Charge Certificate.

Frequently Asked Questions

If I pay the 50% discount, can I still appeal?
No. Payment of any amount — including the discounted amount — is treated as acceptance of the charge. Once paid, the right to appeal is extinguished. Use the discount period to assess your grounds, then either pay (if you have none) or submit your informal representation.
What is the difference between the Notice to Owner and the original PCN?
The PCN is the original penalty charge notice issued at the scene or by post. The Notice to Owner is the formal statutory notice sent to the registered keeper, triggering the appeal clock. The 28-day appeal window runs from the NtO, not the original PCN date.
My 28-day representation was submitted but the council ignored it — what now?
Councils have 56 days to respond to informal representations. If they exceed 56 days without responding, the representation is deemed accepted and the charge cancelled. Document your submission date precisely.
Can I go directly to Traffic Penalty Tribunal without a council rejection first?
No. The informal representation stage is mandatory. You must submit to the council first, receive a formal Notice of Rejection, then appeal to the tribunal within 28 days of that rejection.
