How to Appeal a Bus Lane PCN
Summary
Bus lane enforcement catches more motorists than almost any other traffic contravention — London alone issues over 600,000 bus lane PCNs annually. These are civil penalties under the Traffic Management Act 2004, typically £130 in London (£65 if paid within 14 days) or £70 outside London (£35 discounted). The appeal process follows the same path as other council PCNs: formal representations, then the Traffic Penalty Tribunal. Common winning grounds include unclear road markings, missing or non-compliant signs, unavoidable circumstances (emergency vehicles, road obstructions), and errors in the camera evidence.
How bus lane enforcement works
Councils use CCTV cameras to monitor bus lanes during restricted hours. The camera captures still images or video of vehicles entering the lane. A civil enforcement officer reviews the footage and issues a PCN to the registered keeper. The restriction is defined by a Traffic Regulation Order (TRO) and must be indicated by signs compliant with TSRGD 2016 — diagram 958 (bus lane sign) and diagram 1048.1 (bus lane road marking).
Grounds that win bus lane appeals
Check whether any apply:
- ✓Signs were missing, obscured, or did not comply with TSRGD 2016 diagram 958
- ✓Road markings were faded, broken, or absent where TSRGD 2016 requires them
- ✓You entered the bus lane to avoid an obstruction or emergency vehicle
- ✓The camera footage does not clearly show your vehicle in the restricted lane
- ✓The restriction was not in force at the time shown (check the TRO hours)
- ✓You were making a permitted left turn across the bus lane
Challenge and appeal timeline
Deadlines:
- 1PCN received → pay discounted amount within 14 days (London) or 21 days (outside London), OR
- 2Submit formal representations to the council within 28 days of Notice to Owner
- 3Council responds (4–8 weeks) — accepts or issues Notice of Rejection
- 4Appeal to Traffic Penalty Tribunal within 28 days of rejection
- 5TPT adjudicator decides on paper or by telephone — binding on the council
The left-turn exception
Many bus lanes allow vehicles to cross when turning left into a side road. If you entered the bus lane within a reasonable distance before the left turn, this may be a valid defence. Check the TRO and the signage — some bus lanes explicitly permit left turns, others do not.
Signage requirements
TSRGD 2016, Schedule 11, Part 4: bus lane signs must display the restricted hours, permitted vehicles, and any exceptions. Diagram 958 is the mandatory bus lane sign. Diagram 1048.1 is the mandatory road marking. If either is missing or non-compliant, the restriction may be unenforceable per Vine v Waltham Forest LBC [2000].
London bus lane enforcement
London councils issued over 600,000 bus lane PCNs in 2023/24. Outside London, the figure exceeds 300,000. Bus lanes are the second most common civil traffic contravention after parking. Source: London Tribunals annual report; TPT annual report.

Frequently Asked Questions
- Can I drive in a bus lane outside restricted hours?
- Usually yes — most bus lanes operate during specific hours (e.g., 7–10am and 4–7pm). Outside these hours, the lane is available to all traffic. Check the signage for the exact times.
- What if I entered the bus lane to let an ambulance pass?
- Moving to avoid an emergency vehicle can be a valid defence, but it is not automatic. You must show there was no reasonable alternative. The TPT has allowed appeals on this ground when the motorist had no other option.
- Are bus lane fines criminal?
- No. Bus lane PCNs are civil penalties — no criminal record, no court conviction. They can escalate to a county court debt if unpaid, but this is a civil matter.
