When This Defense Applies

This defense applies where you have independent evidence that your actual entry and/or exit time was different from the ANPR timestamps on the PCN. Common ANPR errors: camera clock drift where the device has not been synchronised; partial plate reads where the ANPR captures a similar plate rather than yours; exit captured but entry missed (or vice versa), making the apparent stay far longer than actual; vehicle parked in an area not covered by exit ANPR, leaving an open-ended entry record.

Evidence Required

The stronger the independent evidence, the stronger the defense:

  • Dashcam footage showing entry and exit times with timestamp
  • Receipts with timestamps from nearby businesses showing when you were in the area
  • Phone GPS history or Google Timeline showing your location at entry and exit
  • Bank transaction timestamps showing when you were at nearby businesses
  • Photos with EXIF metadata showing time at the location

Operator-Specific Patterns

Smart Parking: ANPR-only enforcement. Can I request the ANPR images?
Yes. You have the right to request the ANPR photographic evidence under GDPR (Subject Access Request). You can also request calibration records for the ANPR system. The operator must provide these. If they cannot produce clear images of your specific vehicle, that weakens their case.
My dashcam was not recording — what other evidence can I use?
Google Maps Timeline, bank transaction records, receipts with timestamps, phone call logs, and witness statements can all support your claimed parking duration. Even a combination of weaker evidence (e.g., a receipt showing you were at the adjacent shop at a particular time) can raise sufficient doubt.
What if the ANPR image shows the wrong number plate?
If the ANPR captured a different vehicle's plate or misread your plate, this becomes the 'incorrect vehicle details' defense as well as an ANPR error defense. Request the original ANPR images and compare the captured plate character-by-character with your registration.
Can I request calibration records?
Yes. The BPA Code requires ANPR systems to be regularly calibrated. You can request calibration records in your appeal. If the operator cannot demonstrate their system was calibrated on or around the date of the alleged contravention, this undermines the reliability of their evidence.
